Comparison of legal regulation of patents in the Czech Republic and the People's Republic of China - Abstract This thesis compares legal system of patents in Czech Republic and People's Republic of China with the focus on Patent Laws and other legislation in respective countries. The aim of this paper is to present the approach that Czech and Chinese society adopted with respect to patent law, together with its' historical evolution in both compared countries. This historical insight into the evolution of patent legislation is aimed to help the reader to understand, why certain legislation is present in national patent laws, even though both countries are members of WTO and WIPO and parties to Paris Convention for the Protection of Industrial Property. Another goal of this thesis is to compare the national patent legislation of individual patent institutes, to highlight the differences of such patent institutes and map the influence that the international treaties and international organizations have on the national patent legislation of its' respective country. Finally, this thesis will attempt to briefly introduce the Chinese system of patent enforcement and its practical application when the patentee seeks patent enforcement with Chinese authorities. Comparison of patent law in the EU countries

This Diploma thesis, called "Comparison of patent law in the EU countries", deals with legislation of invention patents and their protection in selected countries such as Germany and the Czech Republic. Within Europe there is an attempt to harmonize the legislation in the field of intellectual property rights in all member countries and to create a unified legal system. A patent is the most important object in protection of industrial property. The secondary objective of this thesis is focused on the identification of the re-sponsible authorities and to determine the financial and time requirements for obtaining a patent. Next major objective is the evaluation of the use of the patent protection within the Czech and German universities, research organizations and private companies and then their transfer of technologies. The practical part contains the analysis of both selected countries from the per-spective of patent law, valid legislation, the responsible institutions and patent statistics for the last ten years. Additional chapter discusses the results of research and development in the university environment at three universities in the Czech Republic and Germany. The analysis is focused in particular on the procedure of obtaining a patent, then also the influence of the local authorities. The comparison of these two countries has revealed some certain similarities, but also striking differences between them. The Czech Republic is currently also slowly dis-covering the benefits of patent protection, but the results can be evaluated only after some time interval.

Submitted master thesis discusses patent law legislation in the Czech Republic. The purpose of this thesis is to examine current legislation in particular with the focus on gaining the patent protection as well as following proceedings and to point out possible uncertainties and particularities of such proceedings given by special nature of patent proceedings in relation to administrative proceedings in general. Considering the mutual bond between the substantive and procedure patent law, this thesis also deals with selected substantive issues. Except for the introduction and the conclusion the work is divided into six chapters. These chapters are notionally split in two main parts. First part consists of first three chapters and is considered to be the introduction to the issue of patent law; second part, consisting of last remaining chapters, represents the core of the thesis on its own. The Abstract Protection of the results of creative work from the view of theory and practice The purpose of my thesis is to analyze the protection of results of creative work, when I try to find the purpose of this protection and take a look at theoretical and practical parts of this sort of law. The thesis is composed of nine chapters, each of them dealing with an autonomous area of protection or with other actual topics. Chapter One is introductory and defines key terms used in the thesis and their systematics. Chapter Two examines with the historical evolution. The chapter consists of three parts. Each part deals with different category. First is general, second is international and third is focused at Czech evolution of legislation. Chapter Three is subdivided into nine parts and provides the main topic of inventions and patents granted to them. Patent law in Austria and CSR - application at Skoda works till the year 1939

I limited the content of the work to arms production. Overview of patent law development in Bohemia in 19th and a part of 20th century is not narrowed. Protection of patents - inventors protection law was first adapted by law in 1832, second more sophisticated "new prerogative law" in 1852. Invention protection law from 1897 solves the same issues like prerogative law from 1852. Patent protection was valid for 15 years. There was only one central "patent office" for patent protection of all inventions based in Vienna . "Register of patents" made an entry of granting a patent. Patent court was appropriate for reviewing of the decision of the Office. National Assembly adopted patent law from 1897 and in 1919 extended its validity to "the whole area of Czechoslovakia". The law from 1922 added a lot of partial changes and also listing of fees. In 1923 a new regulation was issued which changed the inner organization of the Patent Office and its personnel. In 1924 Patent Office rules of procedure were modernized. Administration of patents in join-stock company, former Škoda Works, foundation and development of the company. The American patent infringement damages framework as an inspiration for a suggestion for the Czech framework

The theses is dedicated to the methodology of patent infringement damages calculations in the American and Czech legal environment. The methodology is first defined in terms of the US legal framework. The main focus is devoted to the methods of determining the royalty rate, as the thesis describes the Goergia-Pacific factors analysis and also additional methods recommended by literature are taken into account. Based on the identification of the main differences between the American and Czech damages legislation, it analyzes an applicability of the American framework in the Czech Republic.
Terms of patentability in the law of selected states and in international law

Thesis deals with the patentability of an invention in terms of the law of selected countries and international law. The theoretical part contains a general introduction of patent law, its principles and differences in regulation in selected legal systems. Further analysis is focused on the regulation of conditions of patentability, namely novelty, in European law. The practical part contains an analysis of the decisions of the European Patent Office and the Industrial Property Office of the Czech Republic in selected areas of assessing the novelty of the invention. On the ground of the previous decisions will be identified the issues which are the most frequent subjects of disputes; will be pointed out the controversial decisions and will be identified the key criteria on the basis of which should be in similar disputes in the future decided.

The crime of violation of rights to the protected trademark, trade name, and protected designations of origin and the crime of violation of industrial rights

This work deals with the criminal protection of industrial rights, more specifically with the Article 150 of Criminal Code called the crime of violation of rights to the protected trademark, trade name, and protected designations of origin, and with the Article 151 of Criminal Code called the crime of violation of industrial rights. After a brief introduction to the industrial rights and to the ways of their protection in general I am trying to focus on criminal law concepts such as crime and its own merits. The main subject of the work are the crimes mentioned above for the understanding of which is necessary to extensively analyse the industrial institutes.
